John Forrest Parker, the appellant, was indicted for capital murder for pecuniary gain in violation of Ala. Code 1975, §
13A-5-40(a)(7). The jury found him "guilty of the offense of capital murder" and, by a vote of ten to two, recommended that
he be sentenced to life imprisonment without parole. The trial Judge overrode the jury's recommendation and sentenced Parker
to death by electrocution. This appeal is from that conviction and sentence. I.
